    Frequently Asked Questions

What key details must be included in an employment termination letter in Saudi Arabia to comply with the law?

The letter must state who is terminating the employment, the date of termination, the reason for termination. For indefinite‑term contracts, the legal notice period must be respected unless lawful cause for immediate dismissal exists.

Immediate termination (without notice or end‑of-service benefits) is allowed only under specific, serious grounds. These include severe misconduct, dishonesty, assault, failure to fulfil essential contractual obligations or safety orders (even after warnings), forgery, deliberate financial loss, or unjustified prolonged absence. These are defined under conditions for dismissal for cause.

Under typical indefinite‑contract arrangements, when wages are paid monthly, the employer must provide at least 60 days’ written notice before termination. If payment is not monthly, the minimum notice is 30 days. The employer may instead pay a salary instead of notice if agreed.

The employer must provide proper notice (or payment instead), document reasons, and treat termination as a standard contract ending. It happens only if termination is not for a cause defined under the serious misconduct clause, like poor performance rather than misconduct. Failure to follow notice procedures or give a valid reason may expose the employer to claims for wrongful termination, end‑of‑service benefits, compensation or even reinstatement.

Automation tools can standardise generation of termination letters with required fields (termination date, reason, notice period, contract type), automatically calculate notice or payment‑in‑lieu amounts based on the pay schedule, track the history of warnings/misconduct documentation, store requisite records, and flag when criteria for immediate dismissal are met, helping ensure legal compliance and reducing human error or oversight.
